New Jersey Sports Betting Laws

It took a legal battle that lasted almost a decade for sports betting to become legal in New Jersey. However, once the battle was one, it resulted in a nationwide change to sports betting laws and was a victory for sports fans everywhere.

The state first tried to pass sports betting legislation around 2009 and this resulted in a court case between former New Jersey Governor Chris Christie and the five biggest sports leagues in the US, the NCAA, NBA, NFL, NHL and MLB.  When Governor Phil Murphy was elected in 2018, he inherited the battle and didn’t give up.

New Jersey was arguing that under the Tenth Amendment, sports betting falls under states’ rights. The leagues were arguing that the Professional and Amateur Sports Protection Act (PASPA) of 1992 prevented state-regulated sports betting. When New Jersey passed its sports betting bill in 2012, the leagues immediately filed an injection.

New Jersey lost the initial battle in the District Court and then two more in the Third Circuit Court of Appeals, one in front of a group of three judges and another “en banc” hearing before the full panel. Each of those rulings went in the leagues’ favor, meaning that the only option left to New Jersey was an appeal to the US Supreme Court. Many where surprised when the Supreme Court agreed to hear oral arguments from both sides in December 2017 as the court consents to hear just a small number of the cases presented to it.

Victory finally arrived for New Jersey on May 14, 2018 when the Supreme Court broadly ruled in its favor and PASPA was stricken down. It was a 6-3 majority decision that was written by Justice Samuel Alito. It then took less than a month for Gov. Murphy to sign an updated New Jersey sports betting bill into law on June 11, 2018 and he placed the first legal bet in the state just a few days later.

The legislation made it legal for the state’s casinos and racetracks to have physical sportsbooks onsite. It wasn’t long before online and mobile betting was also approved. Now, those in New Jersey can bet on professional and college sports, with the exception of college sports taking place in the state or those involving in-state teams. It is also forbidden to bet on high school sports and e-sports in New Jersey.

New Jersey’s legislation does not include integrity fees, but it does contain taxes. Casinos must pay 8.5% on land-based bets and 13% on electronic bets. Racetracks pay the same taxes plus an extra 1.25% on electronic wagers. Furthermore, all US sports bets are subject to federal taxes of 0.25%.

Each casino and racetrack can have up to three mobile skins operating off their license, which costs $100,000 when issued. Internet gambling licenses cost $500,000 as well as a $250,000 responsible gambling fee.
